These terms govern Maximus Terminal (“Maximus”), a mobile SSH, tmux, and mosh client from Serious Engineering. Maximus is coming soon to the Apple App Store and Google Play. By installing or using the app, you agree to these terms.

The product

Maximus lets you connect from your device to remote hosts you specify. Windows and panes from tmux control mode appear as native tabs and splits. Mosh, when you choose it, is for roaming links. We license the app to you; we do not grant rights in the remote machines you reach with it.

Your hosts, your keys

You are responsible for the hosts you add, the credentials you store, and the commands you run. Use Maximus only on systems you are allowed to access. We are not a party to your relationship with those systems and we do not see session contents.

Stores

Distribution through the App Store is also subject to Apple’s Licensed Application End User License Agreement. Distribution through Google Play is also subject to Google Play’s terms. If those store terms conflict with these terms on a point the store requires, the store terms control for that point.

Acceptable use

Do not use Maximus to break the law, to attack systems you do not control, or to interfere with other people’s use of networks. Do not reverse-engineer the app except where a statute gives you that right and you exercise it.

No warranty

Maximus is provided “as is.” Remote networks fail. Terminals misbehave. We do not warrant that a session will stay up, that a paste will be safe, or that the app is free of defects. To the fullest extent the law allows, Serious Engineering disclaims implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Limitation of liability

To the fullest extent the law allows, Serious Engineering is not liable for lost profits, lost data, lost access to a host, or any indirect, incidental, special, or consequential damages arising from Maximus. Our total liability for any claim relating to the app is limited to the amount you paid us for it in the twelve months before the claim, or ten US dollars if you paid nothing.
